| 03:15pm | Corporate Digital Investigation: The China Challenge The 2011 CyberSecurity Watch Survey reported that 21% of attacks are caused by insider and 33% view the insider attacks are more costly. Moreover, it was found that the insider attacks cause additional harm to organizations that could be difficult to quantify, e.g. organization’s reputation, loss of confidential or proprietary information, etc. Many corporates in Hong Kong have close relationship with China, such as holding company and subsidiary, business partners, etc. These relationships usually require transfer of confidential or proprietary information. On the other hand, IP theft is a well-known problem in China, e.g. software copyright and machine design.
In Hong Kong, if an organization suspects there is digital data leakage by an insider, the management may conduct an internal investigation through the internal audit, external auditor or hire professional digital forensic service. According to the legal system in Hong Kong, these auditors or the forensic professionals could produce an expert report and appear in the court as expert witness if necessary. If similar incident appeared in China, how should the corporate react? Could the corporate hire professional digital forensic services in Hong Kong to conduct the investigation?
In this talk, the speaker will briefly describe the digital forensic legal system in China and highlight what the corporate should do when perform digital forensics and investigation in China.
